Dear Lawyer Xes

I received this via email the other day, and was wondering whether it is true. Please enlighten us. I’m sure we’d all want to know!

Something for us to know…..
I was talking with a lawyer friend of mine. We were discussing the law and women`s rights. She told me about this incident – a young girl was raped by a man posing as a plain clothes officer ; he asked her to come to the police station when she and her male friend didn’t have a driver`s license to show. He sent the boy off to get his license and asked the girl to accompany him to the police station. Took her instead to an isolated area where the horrendous crime was committed.
In fact, the law clearly states that between 6 pm and 6am , a woman has the right to REFUSE to go to the Police Station, even if an arrest warrant has been issued against her. It is a procedural issue that a woman can be arrested between 6pm and 6 am, ONLY if she is arrested by a woman officer and taken to an ALL WOMEN police station. And if she is arrested by a male officer, it has to be proven that a woman officer was on duty at the time of arrest.
It is good for us to know our rights. To what extent it comes of use remains to be seen in any situation. But as they say, knowledge is power.
Just thought I`d share this with you.

How? Can I drive off from a road block and refuse to go to the police station and then have them chase me home and arrest me and I’ll be forced to do nude squatting (and someone will record it on his mobile phone and it’ll be all over the internet)?

  1. I say man ..this is the statement that is bull
“It is a procedural issue that a woman can be arrested between 6pm and 6 am, ONLY if she is arrested by a woman officer and taken to an ALL WOMEN police station.”
yeah..what happened crimes during 6 am and 6 pm?and there is an ALL women police and ALL men police station in KL?Are we in places like supermarket queues segregated by sexes..
not all emails can trusted…like this

  2. efly&bimbobum: ive read the criminal procedure code and police act and i dont see any sections which states the above. i doubt its true though.
TBG: thanks to you, kimberly and mypartners! 😀
    CGH: yup exactly!
    abner: never heard of one!

  3. i don’t think you can drive off from a roadblock.it’s a totally different scenario.
if situation like potraited in the email, i think you have all the rights in your hand to sped off to the nearest police station to seek cover.even if you’re culpable for any offence on the road, you as a female can always invoke physical characteristic indifference as a defence for not stopping in the middle of the night for an alleged plain cloth officer.

  4. No such procedure exists inside the Criminal Procedure Code. The only way to find out whether such a pracitise exists is through the police force’s own internal action code and guidelines… and the public of course, is not privy to such documents or guidelines.
I am aware however, that it is a practise in the police force for police women to handle matters concerning women… as far as it is possible. That means bimbobum, if you have been drinking and driving, that does not give you the right to drive away from the road block without getting arrested if there are no police women on duty there.

  5. i wonder why this debate is even going on. Isn’t ironic that we even have rules to defend us from the people (aka cops) who have a sworn duty to uphold law enforcement and yada yada all that bs.
    anyway dirty cops. bah.
