When I was young, I found a can of beer in my fridge. I’ve seen people drinking beer on TV and they seem to enjoy it. So out of curiosity, I took the beer and had a sip of it. It ended up in the rubbish bin thereafter. It was terrible!

Years later, I decided to give it a try again. It wasn’t so bad. However, I soon realize that whenever I drink beer, I get blocked nose and a few KGs heavier thereafter.

Then I found Guinness!

It was bitter at first but after a few drinks, I got fond of it. It tastes creamy and thick. Unlike beer, the foam of is best part of the drink!
After drinking it for a few years, I realize that Guinness has a long history behind it. It was created 250 years ago in Ireland by a man by the name Arthur Guinness. 4 years later, he acquired a 9,000 year lease on the four-acre brewery at St. James’s Gate from Mark Rainsford for an annual rent of £45. The lease still exists today at the Guinness Storehouse in Dublin!

And this month, Guinness is sending someone to Dublin, Ireland!

Social networking sites such as Facebook and Twitter have allowed people to easily let others know what is on their minds. But users should be careful with what they post because the laws of the land apply to cyberspace as well.

THE Internet is increasingly becoming a virtual soapbox for people to vent their thoughts – and sometimes frustrations and dissatisfaction. The proliferation of blogs, discussion groups, and more recently, social networking, have emboldened many – with the assumption that making comments from behind a screen shields them from any legal repercussion.

However, the long arm of the law extends beyond solid ground, and reaches into the virtual realm as well.

According to H.R. Dipendra, from the Malaysian Bar Council’s human rights committee, there is no distinction between comments posted on the Internet and traditional print media.

“Internet posts are subject to similar laws as that of print media, aside from the Communications and Multimedia Act 1998 (MCMC Act) and Printing Presses and Publications Act 1984.


False sense of security: People on social networking sites and blogs tend to say more than they do in real life, thinking they can do it anonymously.

“You have to be careful what you write, and not just post what comes off the top of your head. If you know it to be inflammatory, then you should be careful,” he says.

Eddie Law, blogger and founder of elawyer.com.my and laweddie.com.my says that the www header is not an acronym for the wild wild west.

“Some think they can post or write anything, but that is not true,” he says.

Examples of legislation (see chart) include the Sedition Act, Internal Security Act, as well as civil and criminal defamation laws – all of which have previously been invoked to bring an individual to court, most famously in the cases involving blogger Raja Petra Kamarudin.

More recently, DAP member Teng Chang Khim was summoned to appear before the party disciplinary committee for a Twitter message that read “OMG! Real culprit freed.”

Dipendra says what has happened to Teng is fascinating, but does not believe anything will come out of it.

“His statement is not defamatory as it does not specifically refer to any particular person. It is a general opinion on a general matter,” he says.

Posting news content on Internet blogs, for example, is in some way similar to what mainstream news journalists do, but Law feels that bloggers are at a distinct disadvantage.

“They do not have proper media training or resources to help them determine what they are doing is legal.”

He opines that as social networking and blogging activity is still relatively new, there is little legal precedent to follow and there are many issues yet to be tested in court.

“The wording of the MCMC Act (Section 233 and 211) is very broad, and there is a lot of uncertainty. Because it is not yet tested, you can be snagged if its wording can be defined to suit your case,” he says.

Dipendra shares a similar opinion, and believes that when the law was drafted, it was intentionally broadly-worded.


Law

“It can be of any mode, medium or application – SMS, iPad or Twitter – so long as you type out a comment and post it, you will fall within the ambit of the two sections.

“The law is broad enough to include everyone, even an innocent disseminator,” he says.

However, he does not think it is a bad law.

“It may be uncertain and ambiguous, but not bad law. It gives enforcement agencies a lot of leeway so they would have the unfettered discretion for its use. The only question is if this discretion is used fairly,” says Dipendra.

Anonymity not guaranteed

Foong Cheng Leong, from Lee Hishammuddin Allen & Gledhill’s intellectual property department, says that people tend to say more than they do in real life, thinking they can do it anonymously.

“They think they can get away with it, but they may still get caught,” he cautions.

He gives the example of the Stemlife Bhd v Bristol-Myers Squibb (M) Sdn Bhd case. The co-defendant, Arachnid Sdn Bhd, who provided website maintenance services, was ordered to reveal the names of the persons who posted disparaging remarks against the plaintiff.

However, in a separate defamation suit involving the same parties, the judge struck out the suit against Arachnid, as it had never played an active role in respect of the content of the comments posted on the website.

There was another case where the defamatory contents of a website were deleted, but the lawyers were able to find the offending page using archived pages on waybackmachine.com.

“Simply deleting the page is not a defence, as the damage may have already been done. In a way, it is like destroying the evidence,” says Foong.

However, Law says web service providers need immunity from content posted on their website, something that United States law provides for in Section 230 of its Communi­cations Decency Act.

Foong informs that a similar “safe harbour” provision is being drawn up in Malaysia, and the same kind of immunity may later be found here.

Dipendra also says that what is posted on cyberspace stays there forever.

“Something that you said 10 years ago on a website may resurface, and you may have no recollection of even writing it.”

While existing Malaysian law appears to cover cases of wayward online behaviour at the moment, there are some who feel that there is a need for the law to be reformed.

Sonya Liew of the Bar Council explains that the world is currently undergoing both a revolution and evolution at the moment.

“Just like how there was the industrial revolution before, now we are having an information revolution,” she says.

She explains that during the agrarian age, laws were formed to protect the land, and during the industrial age, to protect intellectual property with laws regarding copyright and trademarks, for example.

“Laws regarding sedition and secrets were passed many years ago, before the information revolution. But now, society has evolved beyond this,” she says, adding that the people’s expectations regarding the right to information have evolved – together with technological advances.

“The whole world now has information at its fingertips, and if you withhold information, people start to question the lack of access to it.

“People expect information, and the question is if existing laws are sufficient to provide for the needs of a modern society,” says Liew.

She notes that signs of this can be seen in the increasing call for freedom of expression and the right to information.

“Later, we will hear of even more rights that we have not even heard of before, and it may even eat into the right to privacy,” she says, explaining that this may arise as people may want to know more about government officers’ or politicians’ lifestyle – in order to reduce graft.

“Laws exist to serve society, and society does not serve the law. We have this need now, and the question is if the Government is doing enough to provide for this need,” says Liew.

Any significant legal reform on the use of the Internet is not yet on the horizon, and until then, social networkers and bloggers should be vigilant on their online behaviour.

“People should behave the same way online as they would in real life. If they do not shout and curse in public, then their behaviour should remain the same online. They should not wear a different hat in cyberspace,” says Law.

Foong succinctly describes the appropriate online behaviour with a biblical quotation – which is still as relevant today as it was 2,000 years after it was uttered.

“Do unto others as you would have them do unto you,” quotes Foong.

Today I will talk about this…


No, not South Korea..

But the logo inside the South Korean flag. If you didn’t know, the logo originates from the ancient Chinese book of I Ching, one of the fundamental books of Confucianism.

When I was very young, my Dad drew me a picture of 6 lines.


He told me, “Boy, if you want to succeed in life, remember these 6 lines. This is from the book I Ching”.

Intrigued, I gave him my utmost attention.

“Imagine, after you graduate from university and join the workforce, let’s say, you will be in line No. 4 from the bottom. The bottom 2 lines are for those who didn’t graduate from a higher learning institution”.

“The 1st line is where the top businessman and directors are. The 2nd line is where the senior management is. The 3rd line is where your seniors are”. Your aim is to reach the 1st line. How are you going to reach there?”

I shook my head vigorously.

My Dad then said, “You get the people on the upper lines to bring you up. They’re the ones who will help you succeed in life”.

I held on to his advice until today. It sounds simple and practical.

But how am I going to get the people in the upper line to help me up? If I am up, how do I maintain myself to be there?

To me, a plan must be set out. It must detail the timeline and the goals to be achieved within a given timeline.

Those who you think would help your career should be identified.

Who is that? Your coworkers. As much as you like being a lone raider, teamwork is always good for both of you and the company. It also helps showcase your leadership skills.

Why do I need this ally? For support and advice. Running out of time and it seems impossible to get everything together all by yourself? You’ll find help comes easily if you’ve made an effort to create allies among your workmates. They’ll also be more willing to share more information and ideas with you if they like you.

How to stay chummy with them? Don’t wait until near deadlines. You should offer help when you see that they seems to be struggling or running around like a headless chicken. And never, ever, ever gossip or ‘cucuk’ them in the back, you’ll lose their trust and allegiance.

3. The Big Guys Ally

Who is that? Your senior management. This includes your superior, boss, senior partners, CEO etc.

Why do I need this ally? For career advancement. Without your boss or the senior partners recognising your talents and contributions, you could stay in that position of yours for years. Maybe even until you retire.

How to stay chummy with them? Offer assistance whenever you can. But only if you know you can handle it without it interfering with your current workload. It is also a good idea to make this ally look good.

4. The Network Ally

Who is that? Acquaintances from other departments and other companies in your industry.

Why do I need this ally? For essential information. In case you hear rumours about future price increases or a new ‘canggih’ design development, this ally will come in handy to keep you informed.

How to stay chummy with them? Keeping them close to you and helping them in any way possible. Also, keep in contact on a regular basis, not just when you need a favour from them.

5. The Client Ally

Who is that? Your customers, of course! A satisfied customer can give valuable referrals when you’re looking for a new job.

Why do I need this ally? For their perspectives and opinions. Your clients can offer helpful suggestions about your business and give valuable input when you’re, let’s say, proposing a new product.

How to stay chummy with them? By showing this ally that you value the relationship. This includes thanking them for their business and giving them information valuable to their business. Providing them a little more information more than what they have asked for would always be appreciated.

Once you have identified the above allies, you have to start working on that relationship. First impression is always important and thus dressing up properly is the key. You have to be pleasant to the eyes, ears and nose. If you got BO problem, get deodorant. If your shirts are old or too baggy, get a new one. If your shoes are not shiny, get KIWI shoe shine!

Boston: Short Update

Hello people!

It’s been a hectic conference in Boston. Been running around like a headless chicken for the past few days. I had meetings after meetings in the morning until the evening and receptions after receptions at night. But its not so bad this time, I have sufficient rest everyday.

Food is good here in Boston. Been eating at Quincy Market almost everyday. Food is cheap and good there.

New York City: Short Update

Hello people!

I’m in JFK airport now waiting for my flight to Boston. I’ll be attending the yearly International Trade Mark Assocation there. It will last about 5 days.

There’s free wifi here and its very fast. There’s also a booth for people to plug in their laptop and order food and drinks through a touch screen monitor. Damn hightech!

Finally my 4-day trip in New York City has finally come to an end. Jet lag didn’t kill me but it had sort of improved my sleeping habit. I’ve been waking up at 6am here everyday – a task which is impossible for me in Kuala Lumpur.


Madison Avenue

The weather had been pretty inconsistent. Sometimes hot and sometimes extremely cold. I didn’t have a thick jacket when the temperature dipped to 11 degrees celcius. It was raining too! I was shivering the entire day!

I moved to my hostel in Brookyln after bunking with Timothy Tiah for a day. I booked a single room for US$40 a night but the single rooms comes with a bunk bed. The room was quite small and doesn’t have a TV.

The area that I stayed seemed safe but there was once a black guy in a truck said to me, ‘Damn that’s a real piece of work u got there!’. I’ve no idea what he was talking about. :s

Also, it gets really scary at night especially when I walk to my hostel from the train station. There was once I got lost walking back at 130am. The street was empty and dark. If its not for GPS, I may be lost throughout the entire night!

Food is provided by the hostel but it gets crowded in the later part of the morning. Waking up at 6am would skip the crowd.

The unfortunate bit about the food is that they do not serve any meat, just bread, pancakes, cereals and fruits. Too healthy for me!

So far, I visited the Statue of Liberty, Ellis Island, World Trade Centre Memorial, Empire State Building, Metropolitan Museum of Art and Woodbury Outlet Stores.

I managed to catch a play with Timothy Tiah and fourfeetnine. It was good but it would be better if I didnt fall asleep at the ending of the play. Heh

Greetings from New York City!

After a grueling 24 hours journey, I am finally in New York City. It was a long and painful flight. The crying babies aggravated the discomfort.

The non-stop journey started when I realised at 8pm, Saturday night that my flight is at 2am, Sunday and not 2pm which I initially thought! I was supposed to attend Frank’s birthday dinner but had to cancel it because I haven’t finish packing yet! A once again saved me by helping me to pack. After packing, I realise that I didn’t book a place to stay in NYC on the 16th night because I thought I’ll arrive on 17th. I was sooo busy the entire week until I didn’t have the time to sort out my schedule!

So A and I scrambled to find a place to stay. The hostel that I booked didn’t have vacancy on the 16th. The other hostels were charging over US90 a night! Fortunately, Timothy Tiah offered his place for me to bunk for a night! *phew*

I had to transit in Dubai airport for 3 hours. Dubai airport has a long strech of duty free shops. I was there at 4am Dubai time and the place was packed. Even men have to line up to use the toilet. I bought myself a cup of coffee and roamed around for 3 hours. The place had enough things to entertaint me for 3 hours.

Rice Crisp by Mister Potato

They recently launched a new type of crisps which it is made from a combination of rice and potato! It has no MSG and 20% less fat than conventional fried potato chips. It is also cholesterol and trans fat free. Notwithstanding the lack of these substances, it still tastes like potato chips – crunchy and tasty!


It comes in 4 flavours, BBQ, Original, Hot & Spicy, Sour Cream & Onion.

I bought the sour cream and & onion flavour. Quite crispy and has a tinge of sour cream and onion. Taste is not too strong but very additive. The best part is, it wont give you bad breath :p Oh, it tastes great with mayonnaise!

Speaking about mayonnaise, I like my rice crisps dipped with condiments. For example, melted cheese, cream cheese, tortilla chips sauce or

Tried this while at Village Park. Decided to replace rice with the Rice Crisps by Mister Potato. In view of the absence of cholesterol and trans fat, I can now afford to mix rice crisps with other oily stuff 😀

Wonderland

Speaking about Wonderland, the word brings me memories. When I was younger, my high school friends and I used to drink at obscure places around my neighbourhood. Then we were pretty poor and what we could afford was some beers from the neighbourhood convenient stores. Thereafter, we will find a quiet place to drink until wee hours in the morning. The usual places we go are usually dark and mosquito infested. Notwithstanding the unpleasant environment, we called the place “Wonderland”.

One of the usual places we hangout is a bridge in OUG above Kesas Highway. The bridge has a small “walkway” for us to sit. We had an excellent view of Kesas highway. And toilet was just around the corner – one of the many trees few feet away.

There were no railings on the “pathway”. Anyone could fall into one of the many gaps on the walkway and fall all the way down.

Years have passed. A few of us migrated overseas. Those who stayed in Malaysia still see each other often. However, the “Wonderland” we go is no longer the dark and infested places. But those “Wonderland” days are sorely missed. Gone were our young and carefree lifestyles.

So back to the Lose Yourself in Wonderland event, brought to you by Encore, it will be held in 7AteNine on 13 May 2010 which is just a street away from Petronas Twin Towers. The special part about this event is that it is a themed based event namely the “Wonderland Theme”. Think Alice in Wonderland! There will be a costume and dance show. Good Bye Chuan Kor Kor

When I first met my brother in law, Chuan, I remember him being a buff man with thick eye brows with big shiny eyes. He was probably in his early 30s at that time. He married my sister and both of them moved into a small apartment in Salak South.

I could still remember the days where he would bring me around on his motorcycle. He would place me on the front seat with my hands on the handle. He would then let me accelerate the motorcycle at my preferred pace. Both of us had no helmet then. Nevertheless, we managed to make few rounds around the housing area he lives.

Years later, we lost touch but we recently met up again. Mum said Chuan just bought a taxi and Mum asked me to give him some support. Since I do travel a bit, I would call him sometimes to fetch me to the airport. After years of not seeing each other, we caught up and spent considerable time chit-chatting. I remember spending considerable time talking about the taxi profession. I also remember him telling me to get married young so that I wouldn’t be too old for my children.

Before Chuan had his taxi, he was involved in some carpentry business. However, he wasn’t feeling well and had to resort to something less strenuous. Driving a taxi was his new found profession.

With a wife and children to support, Chuan made his best effort to provide for them. He worked day and night. But the medical fees were taking a toll on the family.

Chuan was a kind man with a good soul. Unfortunately, life was not kind to him. On 5 May 2010, he passed on. I was with him hours after his death. The sight of him lying lifeless was painful.

The buff man with shiny eyes that I know is no longer here. It is sad to see him leave.
